U.S. FIRST AMENDMENT OF THE CONSTITUTION PEPPER SPRAYED


Unlike a true Democracy, the US is a Republic, which has a Constitution giving certain basic rights that nobody can remove, or diminish.  One of which is the freedom of expression.  As a result, even a majority is prevented from doing so.

"Sam Law, a Jewish American graduate student who took part in a protest at the University of Texas in Austin, recounted his arrest on Tuesday to Al Jazeera.

“I went to hear about the faculty talking about the destruction of universities in Gaza, and at around 12:45pm, a group of students started setting up tents and so I ran there and linked arms with people to defend the tents.

“We saw last Wednesday, the president of our university sending in militarised police – people with guns, riot gear and horses – and so when I ran to the tents, I knew that’s what’s going to happen. As a Jewish American… I needed to be strong and say this cannot happen in my name.

“We were encircled; it took the police several hours to pull people away, one by one, but there was a strong sense of solidarity, resolve among the students and community members. I wasn’t the only Jew; there were other people wearing Kippas.

“There were some people who were pretty badly injured. I saw people who really couldn’t walk because they had injured their ankle, someone covered in blood, people having asthma attacks, people having diabetic crises, people with tears running down their faces with medics putting saline solution in their eyes to help wash it [pepper spray] out.”"

"Prime Minister Benjamin Netanyahu said on Tuesday that the Israeli military will launch a ground offensive in Rafah "with or without" a truce with Hamas in Gaza.

"The idea that we will halt the war before achieving all of its goals is out of the question. "U.S. Supreme Court Justice Clarence Thomas has asked former President Donald Trump’s lawyers about whether they challenged special counsel Jack Smith’s authority to bring charges against the president.

On April 25, the U.S. Supreme Court heard oral arguments in a case about President Trump’s being immune from prosecution for official acts carried out during his presidency. During the hearing, Justice Thomas asked John Sauer, the attorney who represented President Trump in court, “Did you, in this litigation, challenge the appointment of special counsel?” Mr. Smith was appointed to the case by Attorney General Merrick Garland.

Mr. Sauer said that Trump attorneys have not raised such concerns “directly” in the current case at the Supreme Court. However, “it points to a very important issue here, because one of [the prosecution’s] arguments is, of course, that we should have this presumption of regularity,” Mr. Sauer stated.

“That runs into the reality that we have here an extraordinary prosecutorial power being exercised by someone who was never nominated by the president or confirmed by the Senate at any time,” he said.

“We hadn’t raised it yet in this case when this case went up on appeal.”

Mr. Sauer said he agrees with the “analysis provided by Attorney General [Edwin] Meese and Attorney General [Michael B.] Mukasey,” referring to the amicus brief the two former attorneys general submitted to the Supreme Court on March 19.

In it, the two attorneys general noted that irrespective of what one thinks about the immunity issue, Mr. Smith “does not have authority to conduct the underlying prosecution.”

“Those actions can be taken only by persons properly appointed as federal officers to properly created federal offices. Smith wields tremendous power, and effectively answers to no one,” they wrote.

“However, neither Smith nor the position of special counsel under which he purportedly acts meets those criteria. And that is a serious problem for the rule of law, whatever one may think of the conduct at issue in Smith’s prosecution.”

Attorney General Garland appointed Mr. Smith as special counsel of the U.S. Department of Justice, citing several statutes.

However, none of these statutes even “remotely authorized the appointment by the Attorney General of a private citizen or government employee to receive extraordinary criminal law enforcement power under the title of Special Counsel.”

The two attorneys general added there are times when the appointment of a special counsel would be appropriate and that the U.S. Constitution allows for such appointments.

However, “the Attorney General cannot appoint someone never confirmed by the Senate, as a substitute United States Attorney under the title ‘special counsel,’” they added.

“Smith’s appointment was thus unlawful, as are all actions flowing from it, including his prosecution of former President Trump,” they wrote."  Emphasis added.

""Gaza 'freedom flotilla' blocked, activists vow to press ahead""

"Activists convened in Istanbul for an international aid flotilla for Gaza, protested Guinea-Bissau's decision to remove its flag and said they would continue efforts to reach out to Palestinians"

Plans of the International Freedom Flotilla Coalition hit a snag when Guinea-Bissau decided to withdraw its flag from ships that would deliver humanitarian aid to the Gaza Strip. The flotilla was expected to set sail on Friday before the unexpected decision of the West African country.

At a protest in Sultanahmet Square of Istanbul, a group chanting slogans against Israel displayed banners that read: "Stop the Fire on Civilians" and "Free Palestine." Protesters also referenced a ban on the Palestinian flag in 1967, symbolically marching with watermelon slices, an icon at that time.

Speaking on behalf of the group, Marry Ann Wright said the flag of Guinea-Bissau, the flag country of two of the Freedom Flotilla's four ships, had been withdrawn from the ships. Highlighting that one of the flagged ships was loaded with more than 5,000 tons of aid, Wright alleged that Guinea-Bissau's decision assisted Israel in its illegal blockade and genocide against Palestinians in Gaza. Despite the potential repercussions, Wright emphasized their determination to reach the people of Gaza, asserting that Israel's refusal to provide the aid necessary for Palestinians to survive demonstrated how far it would go.

U.N. experts on Friday demanded safe passage for the Freedom Flotilla Coalition, whose ships departing Türkiye will be carrying 5,500 tons of humanitarian aid and hundreds of international humanitarian observers to Gaza. 

"The Freedom Flotilla has the right of free passage in international waters and Israel must not interfere with its freedom of navigation, long recognized under international law," the experts said in a statement.

"As the Freedom Flotilla approaches Palestinian territorial waters off Gaza, it is essential for Israel to adhere to international law, including recent orders from the International Court of Justice to ensure unimpeded access for humanitarian aid," it added.

Stressing that Israel's "genocidal violence" and "starvation campaign" since Oct. 7 now met with famine, they said that Israel is not only "failing to comply with its humanitarian obligations" as the occupying power, but also "restricting humanitarian aid, intentionally bombarding humanitarian convoys, and targeting both aid workers and civilians seeking aid."

They underscored that the Freedom Flotilla Coalition’s demands include an immediate, unconditional and permanent cease-fire, unrestricted access to humanitarian aid, and an end to the illegal blockade of the Gaza Strip.

"The convoy is scheduled for imminent departure," they added.


The Freedom Flotilla Coalition was formed after the 2010 Freedom Flotilla mission, in which Israeli forces killed 10 Turkish civilians and injured 30 others while raiding the flotilla ships in international waters. The coalition brings together organizations working to end the Israeli blockade of Gaza from countries around the world, including Türkiye, Canada, the U.S. and South Africa.

Israel has waged a brutal offensive on the Gaza Strip since Oct. 7. More than 34,300 Palestinians have since been killed, mostly women and children, and nearly 77,300 injured amid mass destruction and severe shortages of necessities. Israel is accused of genocide at the International Court of Justice. An interim ruling in January ordered Tel Aviv to ensure its forces do not commit acts of genocide and guarantee that humanitarian assistance is provided to civilians in Gaza.



"The Guinea-Bissau International Ships Registry (GBISR), in a blatantly political move, informed the Freedom Flotilla Coalition that it had withdrawn the Guinea Bissau flag from two of the Freedom Flotilla's ships, one of which is our cargo ship," the activists said. GBISR was not immediately available for comment.

The Turkish Humanitarian Relief Foundation (IHH) is the primary organizer of the civilian Freedom Flotilla Coalition, which is comprised of human rights activists, including lawyers, doctors and nurses who came together to deliver aid directly to Gaza.

"Without a flag, we cannot sail. But, this is not the end. Israel cannot and will not crush our resolve to break its illegal siege and reach the people of Gaza," the activists said.

The organizers blamed Israel for applying pressure to prevent the flotilla. "It is obvious, and I think it is publicly known, that there has been close contact between Israel and the president of Guinea-Bissau,” organizer and steering committee member Torstein Dahle told The Associated Press (AP), without elaborating.

He said that hundreds of Turkish and international participants were disappointed by the cancellation. "It is very hard for us because it takes time to procure a flag. It’s a procedure that can’t be done in a few days. ... But we’re not giving up.”"

"US student anti-war protesters dig in as faculties condemn university leadership over calling police "

"Students protesting the Israel-Hamas war at at universities across U.S., some of whom have clashed with police in riot gear, dug in Saturday and vowed to keep their demonstrations going, while several school faculties condemned university presidents who have called in law enforcement to remove protesters.

As Columbia University continues negotiations with those at a pro-Palestinian student encampment on the New York school's campus, the university's senate passed a resolution Friday that created a task force to examine the administration's leadership, which last week called in police in an attempt to clear the protest, resulting in scuffles and more than 100 arrests.

Though the university has repeatedly set and then pushed back deadlines for the removal of the encampment, the school sent an email to students Friday night saying that bringing back police "at this time" would be counterproductive, adding that they hope the negotiations show "concrete signs of progress tonight."

As the death toll mounts in the war in Gaza, protesters nationwide are demanding that schools cut financial ties to Israel and divest from companies they say are enabling the conflict. Some Jewish students say the protests have veered into antisemitism and made them afraid to set foot on campus.

The decisions to call in law enforcement, leading to hundreds of arrests nationwide, have prompted school faculty members at universities in California, Georgia and Texas to initiate or pass votes of no confidence in their leadership. They are largely symbolic rebukes, without the power to remove their presidents.

But the tensions pile pressure on school officials, who are already scrambling to resolve the protests as May graduation ceremonies near.

California State Polytechnic University, Humboldt, gave protestors who have barricaded themselves inside a building since Monday until 5 p.m. Friday to leave and "not be immediately arrested." The deadline came and went. Only some of the protesters left, others doubled down. After protesters rebuffed police earlier in the week, the campus was closed for the rest of the semester.

In Colorado, police swept through an encampment Friday at Denver's Auraria Campus, which hosts three universities and colleges, arresting around 40 protesters on trespassing charges.

Students representing the Columbia encampment, which inspired the wave of protests across the country, said Friday that they reached an impasse with administrators and intend to continue their protest.

After meetings Thursday and Friday, student negotiators said the university had not met their primary demand for divestment, although there was progress on a push for more transparent financial disclosures.

"We will not rest until Columbia divests," said Jonathan Ben-Menachem, a fourth-year doctoral student.

In the letter sent to Columbia students Friday night, the university's leadership said "we support the conversations that are ongoing with student leaders of the encampment."

Columbia's president, Minouche Shafik, faced significant criticism from faculty Friday, but retained the support of trustees.

A report by the university senate's executive committee, which represents faculty, found Shafik and her administration took "many actions and decisions that have harmed Columbia University." Those included calling in police and allowing students to be arrested without consulting faculty, misrepresenting and suspending student protest groups and hiring private investigators.

"The faculty have completely lost confidence in President Shafik's ability to lead this organization," said Ege Yumusak, a philosophy lecturer who is part of a faculty team protecting the encampment.

In response, university spokesperson Ben Chang said in the evening that "we are committed to an ongoing dialogue and appreciate the Senate's constructive engagement in finding a pathway forward."

Also Friday, Columbia student protester Khymani James walked back comments made in an online video in January that recently received new attention. James said in the video that "Zionists don't deserve to live" and people should be grateful James wasn't killing them.

"What I said was wrong," James said in a statement. "Every member of our community deserves to feel safe without qualification."

James, who served as a spokesperson for the pro-Palestinian encampment as a member of Columbia University Apartheid Divest, was banned from campus Friday, according to a Columbia spokesperson.

Protest organizers said James' comments didn't reflect their values. They declined to describe James' level of involvement with the demonstration.

Police clashed with protesters Thursday at Indiana University, Bloomington, where 34 were arrested; Ohio State University, where about 36 were arrested; and at the University of Connecticut, where one person was arrested.

The University of Southern California canceled its May 10 graduation ceremony Thursday, a day after more than 90 protesters were arrested on campus. The university said it will still host dozens of commencement events, including all the traditional individual school ceremonies.

Universities where faculty members have initiated or passed votes of no confidence in their presidents include Cal Poly Humboldt, University of Texas at Austin and Emory University."

"US Spends Billions on Overseas Wars, But Who Really Benefits?"

"Concerns over incentivizing global conflicts are rising as the Biden administration requests more than $105 billion in supplemental security spending.

The administration says the money, primarily for Israel and Ukraine, will be good for the economy.

President Joe Biden has described the mammoth spending package as “a smart investment” that will “pay dividends” to U.S. security interests.
Likewise, Assistant Secretary of State James O’Brien described the supplemental as “a very good bargain.”
 
Defense Secretary Lloyd Austin said the money will “flow through our defense industrial base, creating American jobs in more than 30 states.”

However, many are skeptical of the administration’s claims and believe that the massive investment in the defense industry will squander the nation’s ability to adequately address social and infrastructure needs.  Emphasis added.

Presidential hopeful Robert Kennedy Jr. is among them.

“Creating jobs is a poor excuse for a foreign policy that wreaks mayhem around the world,” Mr. Kennedy told The Epoch Times in an email.  Emphasis added.

“If we want to increase employment in good manufacturing and construction jobs, instead of making weapons we should repair our infrastructure and manufacture products that actually serve human well-being.”

Defense Contractor Windfall

Numerous analysts believe that the administration’s supplemental spending request, in addition to its record-breaking defense funding, would effectively serve as a massive transfer of wealth to the defense sector from U.S. taxpayers.

Stephen Semler, co-founder of the Security Policy Reform Institute think tank, said defense contractors stand to reap billions from the administration’s requested supplemental spending request, which would go “mostly to just a few companies.”

“Based on my estimate, the proposal would produce $60 billion in revenue for private-sector military contractors,” Mr. Semler said in an email.

Whether those billions of dollars will adequately serve the national interest is an open question. To that end, he said the Biden administration is now “selling” the spending package as an economic boon because most people won’t believe it would improve national security interests abroad.

“If people don’t buy the foreign policy argument for spending $106 billion, the thinking goes, maybe they’ll support it if it’s framed as domestic policy,” Mr. Semler said.

“By comparison, Biden’s flagship infrastructure bill spends $548 billion over five years.”

Defense Lobby Incentivizing Conflict

A key concern of Mr. Semler and others is the continued incentivization of conflict, in which the defense industrial base may directly or indirectly work to prolong conflicts in an effort to maximize its economic gains.

He pointed to the defense base’s “army of lobbyists,” which pressures the U.S. government to adopt hawkish policies and spending habits in the interest of their for-profit companies.

“When the U.S. buys weapons, it’s empowering a particular set of businesses whose bottom lines depend on the U.S. either making war or preparing for it,” Mr. Semler said. “These firms then redirect a share of their profits back into the political system in an attempt to steer national policy toward more war.

“The only surefire winners are military contractors, so we know what they’ll be pushing for.”  Emphasis added.

Last year, U.S. defense companies spent more than $128 million on lobbying efforts.

The effort included the employment of more than 845 lobbyists, some 72 percent of whom previously worked in government, mostly in the Pentagon or for the House and Senate Armed Services Committees.

Those lobbyists don’t just grease the palms of politicians; they influence the formulation of policy itself through massive cash injections to defense-focused think tanks.

A report published by the Center for International Policy think tank found that government and defense contractors spent more than $1 billion on think tanks from 2014 to 2019.

The top recipients of this funding were the RAND Corporation, the Center for a New American Security, and the New America Foundation, which together brought in more than 600 different donations from U.S. government or defense contractors.

“The top funders from the U.S. government were the Office of the Secretary of Defense, the Air Force, the Army, the Department of Homeland Security, and the State Department,” the report reads.

“The defense contractors contributing the most to these think tanks were Northrop Grumman, Raytheon, Boeing, Lockheed Martin, and Airbus.”

Relatedly, Lockheed Martin, Boeing, Raytheon, and Northrop Grumman were the fourth, fifth, sixth, and seventh largest corporate lobbyists in 2020.

In 2022, the four companies hired a combined 259 former government employees who now work as lobbyists, executives, directors, board members, and trustees.

“Of course, policymaking will always be influenced by ideologies,” Mr. Semler said. “We’ve all got one. But allowing the profit motivations of weapons companies to hold sway over decisions about war and peace is a different beast entirely.

“Some people don’t think this massive redistribution of wealth from taxpayers to private military contractors is a problem. I think it is.”

Congress’s Role

The issue of war profiteering isn’t limited to the executive branch.

Indeed, the revolving door between Congress and the defense lobby is wide, and the real-world policy implications of the administration’s proposed spending will ultimately be realized by the House and Senate.

However, big money has big consequences for members of Congress who rely on agreeable think tanks and also keeping defense sector jobs in their districts to stay in office.

As such, continued congressional support for the Israel–Hamas war, the Russia–Ukraine war, and elsewhere is unlikely to radically shift without a great deal of unrest among voters.

“U.S.-backed wars, from Iraq and Afghanistan to Ukraine and Gaza, have direct ramifications for the U.S. defense sector,” said Antony Loewenstein, an independent journalist and filmmaker who was based in East Jerusalem between 2016 and 2020.

“It’s partly why so few U.S. congressmen and women are willing to challenge the military-industrial complex, because it potentially brings jobs to their district.”

The Epoch Times requested comment on the issue from 31 members of Congress, including the chair and ranking member of the Senate Armed Services Committee. One responded.

A spokesperson for the office of Sen. Rand Paul (R-Ky.) directed The Epoch Times to Mr. Paul’s heated exchange with Mr. O’Brien on the issue of supplemental security funding.

 At that time, Mr. Paul said the administration was “fomenting a war” to increase profits for defense corporations.

“So really, it’s a justification of war,” Mr. Paul said.

“To me, that’s sort of reprehensible. The idea that ... the armaments industry is going to get billions of dollars out of this.”

Biden Risks Base with Continued Wars

The Biden administration’s decision to obfuscate the types of weapons platforms it’s sending to Israel—it previously maintained some transparency in Ukraine—makes things worse, according to Mr. Loewenstein.

“It’s almost as if elements of the White House prefer secrecy to sunlight,” he said.

One reason for the opacity may be the decreasing popularity of the Biden administration and its continued funding of foreign wars.

President Biden has an approval rating of just 39 percent among Americans, according to Reuters polling.

That same polling found that the economy has been the most important issue to Americans for the past 113 consecutive weeks, perhaps hinting at the administration’s efforts to rebrand the supplemental security request as a domestic priority.

Continued Pentagon Audit Failures

To be sure, it can be difficult to tell where legitimate security concerns end and war profiteering begins. Further complicating that complexity is the Pentagon’s inability to account for its spending.
 
As of this month, the Pentagon has failed to get a passing grade on an auditing of its accounting for the sixth year in a row.
Only seven of the Pentagon’s 29 sub-agencies received a passing grade, presenting no improvement from the previous year. The systems that track $3.8 trillion in military assets fail to do what they are supposed to do, an independent audit shows.

That’s a real problem, given the fact that the supplemental request doesn’t aim to provide money to embattled nations or sell them arms but rather to directly transfer old arms and then hand the money to American defense corporations to replace them.

The lack of transparency by the administration, the Pentagon, and the associated defense companies could therefore encourage a more general lack of accountability by U.S. leadership for ongoing violence in the foreign wars it funds, according to William Astore, a retired U.S. Air Force lieutenant colonel.

Like Mr. Semler, Lt. Col. Astore suggested that the administration should invest in more and better jobs at home and pull back from knee-jerk defense spending.

It’s an issue that every American should care about, he said, because the nation will be stronger if that funding is directed somewhere else.

“Americans should care,” Lt. Col. Astore said, “because we as a country can create more jobs by investing in America rather than exporting deadly weaponry worldwide.”

The Eisenhower Moment

Lt. Col. Astore referred to former President and retired five-star General Dwight D. Eisenhower, who in a 1953 speech urged against reckless military spending following World War II and the Korean War, when such dollars could be spent on infrastructure that would improve the prosperity and well-being of Americans instead.
It was President Eisenhower again, in his 1961 farewell address, who coined the term “military-industrial complex.”

A massive and permanent military was “new in the American experience,” and quite ironically, could threaten the nation’s continued security and liberty if overinflated in the pursuit of security and liberty, according to President Eisenhower.

It’s just such an apparatus that concerns Mr. Kennedy, Mr. Semler, Mr. Loewenstein, and Lt. Col. Astore.

For President Eisenhower, there was one solution to a runaway military-industrial complex: The power of an informed electorate.  Emphasis added.

“We must guard against the acquisition of unwarranted influence, whether sought or unsought, by the military-industrial complex,” he said. “The potential for the disastrous rise of misplaced power exists and will persist.  Emphasis added.

“Only an alert and knowledgeable citizenry can compel the proper meshing of the huge industrial and military machinery of defense with our peaceful methods and goals, so that security and liberty may prosper together.”  Emphasis added.

Officials from the White House, State Department, and Pentagon didn’t respond by press time to requests by The Epoch Times for comment.  Emphasis added.
